As per provisions of the Odisha Government Rules of Business, sanction for the prosecution of any public servant removable from service by the Govt. is entrusted to G.A.Department. Sanction for prosecution of a public servant is accorded as per provisions of Section-19(1)(b) of the Prevention of Corruption Act, 1988 and Sanction 197 (1) (b) of the CrPC in respect of offences under the PC Act and the IPC respectively.
In respect of AIS officers, proposals for sanction of prosecution are submitted to the Government of India for consideration. State Government is the recommending authority in respect of AIS officers.
